# Grundverständnis von Notfallplänen im juristischen Kontext

Ein Notfallplan ist ein strukturiertes Dokument, das alle Handlungsanweisungen und -maßnahmen enthält, die bei einem Notfall greifen müssen. Er ist weit mehr als eine Telefonliste; er ist das operative Betriebssystem für den Ausnahmezustand. Er stellt sicher, dass wesentliche Funktionen und Mandantenbeziehungen auch in Krisensituationen aufrechterhalten werden können.. Für Kanzleien bedeutet ein solches BCM primär die Sicherstellung der Fristenwahrung, der Kommunikation und der Vertraulichkeit.

Anders als bei den meisten anderen Unternehmen müssen Kanzleien besonders auf den Schutz vertraulicher Mandantendaten und die Einhaltung von Fristen achten. Ein Produktionsunternehmen kann einen Produktionsstopp oft durch Überstunden aufholen; eine verpasste Notfrist in einem Revisionsverfahren ist jedoch irreversibel und haftungsträchtig. Zudem unterliegen Anwälte der strafbewehrten Verschwiegenheitspflicht ([§ 203 StGB](https://www.gesetze-im-internet.de/stgb/__203.html)), was die Einbindung externer Dienstleister im Notfall (z.B. IT-Forensiker) rechtlich komplexer gestaltet als in anderen Branchen.
